Q: What is a Land Trust and how does it protect me and my property?
Florida law provides numerous legal benefits to property owners who use land trusts. The sole purpose of The Fidelity Land Trust Company is to make those legal benefits available to clients. A land trust is an entity that will hold legal and equitable interest in the home with the homeowner being the beneficial owner of the land trust. This gives the owner an interest in personal property (land trust) not real Property. The homeowner cannot have interest in Real Property for these negotiations to work.
Q: How does a homeowner control the Land Trust once the property is conveyed at closing?
Homeowner has complete beneficial interest and RPP is trustee in charge of filing lawsuits and obtaining new mortgage. Homeowner holds 100% beneficial interest at all times. Like an insurance policy, homeowners are the beneficiary.
Q: What if I was just served with foreclosure papers?
If you were just served foreclosure papers we can do a Land Trust and lease for 1 year then arbitration. Ask one of our agents for details.
Q: What is the worst thing that can happen?
The worst thing that can happen is that you lose no money and have a 40% discounted lease on your property covered by the Land Trust and the law firm who’s objective is to keep your home and away from foreclosure.
